1 These terms and conditions apply to all courses provided by MediTrain Bay of Plenty.

1.3 Please read these terms and conditions carefully before purchasing a course. The student purchasing a course must be at least 18 years old, and by paying for the course accepts these terms and conditions.
2.1 The course fees are as set out on the website or as told to you over the telephone at the time you booked your course.
2.2 If not paid at time of booking, course payments are due on or before the day of your course unless arranged otherwise. Payment may be made by electronic funds transfer (online banking), cash, EFTPOS or any other method agreed between you and us.
2.3 Unless we have agreed in writing to extend credit to you, course fees must be paid in full prior to you attending any course.
2.4 Where we have agreed to extend credit to you, you must pay the course fees in full by the 20th day of the month following the month in which the course was provided.
2.5 If full payment for the course is not made by the due date then:
(a) all amounts owing by you to us become immediately due and payable;
(b) we may charge interest on overdue amounts on a daily basis at 15% per annum; and
(c) you will be responsible for and must pay on demand all costs (including debt collection agency costs and legal costs) incurred by us in recovering overdue amounts.
3.1 We are required to ensure students are eligible for a Workplace, Basic or Childcare Recertification course. The Recertification course is only available to students, who have previously attended a Comprehensive Workplace First Aid, Childcare, Basic or Recertification course or the equivalent, completed within the last 2 years. If you previously completed training with another provider, you are required to either send in a copy of your current certificate or, bring it along with you to your course to prove eligibility. Your instructor is required to sight this document.
3.2 If you are unable to produce your certificate or proof of your eligibility for a Recertification course, you will not receive a certificate. If you send proof within 5 days of attending the course, your certificate will be released.
3.3 If you complete a Recertification course but do not provide us with a copy of your previous certificate within 5 days of the course date, or if the previous certificate has expired, then you will be given the option to complete the Comprehensive Workplace, Childcare or Basic First Aid course within 30 days of the course date (subject to availability).
4.1 If you are unable to attend your course, then you should notify us as soon as possible but no later than 48 hours before the course start time. If you have paid in advance, we will provide a full refund to students who notify us up to 48 hours before the start time of your course. Refunds will only be issued to the person or organisation that paid the course fee.
4.2 No refund will be issued to students who cancel within 48 hours of the course start time or fail to cancel at all. These students may rebook for a course held within 30 days of the original course date (subject to availability).
4.3 Students who cancel within 48 hours of the course start time (or fail to cancel at all) and have not yet paid their course fee will be issued with an invoice for the course fee. This course fee must be paid whether the student rebooks for a course held within 30 days of the original course date or not. The invoice will be sent to the address (email or physical) supplied at the time of booking
5.1 A description of the courses together with the dates on which they begin are available on our website. We will provide the courses with all reasonable care and skill in accordance with the description set out on the website
6.1 We may cease to provide you with any courses with immediate effect if you:
a) act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of MediTrain Ltd, any instructor or lecturer who provides the courses or any student who attends any course;
b) steal or act in a fraudulent or deceitful manner towards us or our employees or any other students who may be on our premises or attending our courses;
c) intentionally or recklessly damage our property or the property of our employees or other students attending our courses;
d) are suspected of being intoxicated through alcohol or illegal drugs while on our premises; or
e) are in breach of these terms and conditions.
7.1 You will receive a form for feedback after your course. Any complaints will be dealt with confidentially and every effort made to come to a satisfactory resolution. If you have a complaint regarding your course, instructor, assessment or venue, please discuss with your instructor at the time or email to us at: info@firstaid.kiwi
8.1 Due to circumstances out of our control it is sometimes necessary to cancel courses at short notice. We reserve the right to cancel courses at our sole discretion. We will take all reasonable steps to inform you of any cancellation as soon as possible. We will not be responsible for any costs incurred due to course cancellation. Course bookings will be transferred to another event date as agreed with you
9.1 The course and assessments are conducted in English. In order to receive a certificate and / or the relevant unit standards you are required to pass written, verbal and practical assessments which are conducted in English. If you are unable to do so you will be deemed not competent and will not receive a certificate or the unit standards available.
10.1 If you have a learning difficultly, disability or an illness, which you feel may affect your performance during the course, please contact us to discuss this at the time of your booking.
11.1 Our courses are practical and involve groupwork. You will be required to demonstrate to the instructor that you are physically able to perform set first aid tasks in simulated emergency situations. If you are unable to perform cardio-pulmonary resuscitation (CPR) on the floor long enough for the instructor to assess competency, then you may not meet the requirements for a first aid certificate and/or the unit standards (if applicable).
12.1 Courses must start on time. Students that arrive more than 15 minutes late may be refused entry. No refunds will be provided to late attendees, but bookings may be rescheduled at our discretion.
12.2 You are required to attend the entire course to meet requirements for certification.
13.1 Sexual/Racial harassment and/or discrimination are unlawful and will not be tolerated by us. Students who feel they have been discriminated against or harassed by a fellow student, instructor or staff member should contact us directly.
14.1 All intellectual property rights in the course materials, courses and the speeches made by instructors at the courses are, and remain, the intellectual property of MediTrain Ltd or Skills for Life Ltd.
14.2: You are not authorised to:
a) copy, modify, reproduce, re-publish, sub-licence, sell, upload, post, transmit or distribute any of the course materials without our prior written permission
b) record on video or audio tape, relay by videophone or other means the course given;
c) use the course materials in the provision of any other course or training; or
d) remove any copyright or other notice of MediTrain Ltd or Skills for Life Ltd on the course materials.
